Terms of Use

1. Who can use Dígalo

You must be at least 18 years old and able to enter into a binding contract. Dígalo contains romance and adult themes and is not intended for minors. You may not use Dígalo where it is prohibited by law.

2. What Dígalo is

Dígalo is an interactive story app for practicing Spanish. After a story, you can keep talking with its characters by message and by voice call.

Valentina and the other characters are fictional. Their videos, voices and messages are generated with artificial intelligence. They are not real people, and AI can make mistakes, including in the corrections it gives you. Dígalo is entertainment and language practice; it is not professional, medical, legal or psychological advice, and it is not a substitute for real relationships. We may change, add or remove features over time.

3. Your account

Dígalo creates an anonymous account on your device; you don’t give us your name or email. You are responsible for activity on your device. If you delete the app or its data, you may lose your progress, your chats and any unused call time. Subscriptions can be restored with “Restore purchases” using the same Apple ID.

4. Dígalo Pro subscriptions

• Dígalo Pro is offered weekly ($2.99) or yearly ($49.99) in the United States. The price and period shown in the app before you buy always apply.
• Payment is charged to your Apple ID when you confirm the purchase.
• Your subscription renews automatically at the same price for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within the 24 hours before the period ends.
• Manage or cancel your subscription in Settings › Apple ID › Subscriptions. Cancelling stops the next renewal; you keep Pro until the end of the period you paid for.
• Refunds are handled by Apple under its policies (reportaproblem.apple.com). We don’t give refunds or credits for partial periods.
• If we change the price, Apple tells you beforehand and asks for your consent where required.

5. Weekly chats and call time

• Pro includes a weekly allowance of messages with the characters, currently about 500 replies and 7 personal voice notes, renewed every Monday at 9:00 a.m. Colombia time. We may adjust the allowance to keep the service fair and sustainable.
• Call time is a one-time, consumable purchase (15 minutes, 35 minutes or 1 hour 40 minutes). It does not expire while Dígalo is offered, has no cash value, cannot be transferred, and is non-refundable except where the law or Apple’s policies require.
• Calls use call time by the started minute. Your very first call includes 3 free minutes. Once your weekly messages are used, you can keep chatting with call time: 30 extra replies use 1 minute.
• Call time is linked to your Dígalo account on your device, not to your Apple ID.

6. Rules of conduct

The characters may refuse, change the subject or hang up. If it happens again, we may pause calls for 24 hours, turn off calls or messages, or end your access. If we have reason to believe you are under 18, we end your access.

7. Your content

What you write and say stays yours. You give us a worldwide, non-exclusive, royalty-free license to host, process and transmit it, including through our AI and voice providers, only to run, secure and improve Dígalo. We don’t use your content to train AI models. You are responsible for what you send.

8. Our content

The stories, characters, videos, voices, texts, designs and the Dígalo name and logo belong to Palm Three LLC or its licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use. Content the characters generate for you is provided for that same personal use.

9. Apple App Store terms

If you got Dígalo from the App Store: these Terms are between you and Palm Three, not Apple, and Palm Three alone is responsible for the app and its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple, which may refund its purchase price; to the extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, privacy or intellectual property claims. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use must also follow the App Store’s Usage Rules.

10. Disclaimers

DÍGALO IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We don’t promise any particular learning result, and we don’t guarantee that the service or AI-generated content will be accurate, uninterrupted or error-free.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PALM THREE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO DÍGALO IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50. Some states don’t allow these limits, so they may not all apply to you.

12. Indemnity

You agree to defend and hold Palm Three harmless from claims and costs, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of Dígalo.

13. Ending your access

You can stop using Dígalo at any time and ask us to delete your data. We may suspend or end your access if you break these Terms or if we stop offering the service; if we discontinue Dígalo, we will give reasonable notice in the app. Sections 7 to 14 continue to apply after your access ends.

14. Disputes and arbitration

Most issues can be solved quickly: please contact us first, and we’ll try to resolve your concern informally within 60 days.

If we can’t, you and Palm Three agree to resolve any dispute relating to Dígalo by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court, except that either of us may bring an individual claim in small-claims court. YOU AND PALM THREE WAIVE THE RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS OR REPRESENTATIVE ACTION. You can opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms.

These Terms are governed by the Federal Arbitration Act and the laws of the State of New Mexico, without regard to conflict-of-law rules. Any claim not subject to arbitration will be heard in the state or federal courts located in Curry County, New Mexico.

15. Changes

We may update these Terms. We will change the date at the top and, for important changes, tell you in the app before they apply. If you keep using Dígalo after that, the new Terms apply. If any part of these Terms is unenforceable, the rest stays in effect. These Terms and our Privacy Policy are the whole agreement between you and us about Dígalo.
